Thank you for visiting the MagAir Web Site.
MagAir, the provider of services and the seller of the products on this Site to you, the customer. By ordering products on the site,
you agree to these terms of use.
Limits On Our Liability
If you are buying the products for personal, domestic or household use, then you have the rights and remedies available under the
Consumer Guarantees Act 1993 and the following limitation on our liability does not apply. If you are acquiring the products for
the purposes of business, then the guarantees and remedies provided under the Consumer Guarantees Act 1993 are excluded and the
provisions of this clause apply. You use the information, services, products and materials available from this Site at your sole
risk. In no circumstances will MagAir be liable to you - whether in contract or tort or under any other legal principle - for any
direct, indirect, special, repetitive, incidental, exemplary or consequential damages, or any damages whatsoever arising out of or
in connection with your use, inability to use or performance of the information, services, products and materials available from
this site.
Disclaimer
While every effort is made to keep the information on this site current, prices and product availability are subject to change
and MagAir will advise you upon placement of your order if changes have been made during the time since the site was last
updated and your order is posted. You can then either agree to still purchase the products or alternatively we will refund the
money you have paid.
Returns Policy
MagAir will replace defective products, provided that they are defective and not just because you have changed your mind. It is your
responsibility to ensure you have made the right choice. We will not void any transactions simply because you have made a
"wrong choice" or have changed your mind. Please return your defective goods with a copy of your invoice and a note explaining why
you are returning the goods to us. We will advise you of our returns address when required, email us at
magair@xtra.co.nz.
Ordering
Please send an email to magair@xtra.co.nz to check for the current availabilty and shipping
times. You can download a "purchase order" form for firearms and ammunition by clicking here.
Delivery Within New Zealand
All orders will be delivered by courier. Different products have different delivery times. You will be advised by email when your
order has been dispatched. If your goods are not delivered within 3 days of being ordered, we will notify you by email of the
expected shipping date.
Cancellation By You Prior To Delivery
You acknowledge that MagAir will incur obligations and costs once you place an order with us. Therefore you may not cancel or vary
an order once it has been placed with us unless of course MagAir advise you that delivery cannot be made due to circumstances beyond
our reasonable control.
Events Beyond Our Control
MagAir will be excused from our obligation to deliver goods within the estimated time if that non-performance is due to events
beyond its reasonable control.
Governing Law
Your order and the contract between you and MagAir is subject to the law of New Zealand and MagAir submit to the exclusive
jurisdiction of the courts of New Zealand. The Vienna Convention on the International Sale of Goods does not apply. If you are not
located in New Zealand, MagAir will not be liable for any breach of foreign legislation, code or directive as a result of
you importing any of the products ordered from our site into your country.
Payment For Goods
Payments by direct banking will have orders dispatched as soon as cleared funds show in our account. When you complete your order you
will receive a confirmation email which will give you our bank details for direct banking, or postal address for cheque payments, with
details of your order and the full amount payable.
Privacy Policy
We do not automatically recognise any information regarding your domain or email address when you browse our website. We only
collect the email addresses of those who communicate with us by email or purchase goods from us. The information we collect
is for our internal use only and is not shared with other organisations to help them contact consumers for marketing or commercial
purposes.
